Notice of Foreclosure Sale 75-6025 Ali'i Drive, Apt. No. B201 Kailua-Kona, HI 96740 Notice is hereby given that pursuant to the "Findings of Fact; Conclusions of Law; Order Granting Plaintiff's Motion for Summary Judgment As Against All Defendants and for Interlocutory Decree of Foreclosure" ("Order") which was filed in Wilmington Savings Fund Society v. Kim Blatnick Horton, et al., Civil No. 16-1-421K on September 1, 2017 in the Circuit Court of the Third Circuit, Division 3, State of Hawai'i, the undersigned Commissioner has been directed to sell the real property described herein (the "Property"), as follows: Open House: Tuesday, October 17, 2017, at 3:00 p.m. to 5:00 p.m. and Wednesday, October 18, 2017, at 3:00 p.m. to 5:00 p.m. Auction: Monday, November 6, 2017, at 12:00 p.m. (noon), at the flagpole at Hale Halawai, 75-5760 Ali'i Drive, Kailua-Kona, HI 96740 Property Description: Parcel No. 750190430006 and identified as "APT B201 ALII PARK PLACE CONDO MAP 3783" comprising a 1,294 s.f. 3BR/2BA apartment. Terms of Sale: No upset price; Property shall be sold in its "AS IS" condition, without any representations or warranties as to title or possession, no less than ten percent (10%) of successful bid by cash, money order, certified or cashier's check at the close of the auction; balance paid to the Commissioner upon approval and confirmation of the foreclosure sale by the Court and the tender of the document transferring title to the mortgaged property, Commissioner may require closing through escrow, notwithstanding buyer's preference, and buyer shall pay all closing costs, including but not limited to the costs of conveyance, including preparation of the conveyance document, conveyance tax, escrow fees, recording fees, any proof of title, title insurance, notary fees, and the costs of securing possession of the mortgaged property at recordation. The purchaser is responsible for securing possession of the mortgaged property at closing.
